VDACS announces immediate inspections of inhalable hemp products at retail facilities

The Virginia Department of Agriculture and Consumer Services (VDACS) Office of Hemp Enforcement has announced that it will begin inspections and evaluations of inhalable hemp products at retail locations. This action expands on the agency’s ongoing inspections of edible hemp products.

According to state law, specifically § 3.2-4123, retailers are prohibited from offering or selling regulated hemp products unless certain requirements are met. In addition, § 3.2-4125 gives VDACS the authority to access retail facilities that sell hemp products intended for oral consumption or inhalation and to secure samples of any regulated hemp product or substance meant for human use.

All businesses offering regulated hemp products for sale must have a valid Hemp Product Retail Facility Registration. More information is available on the VDACS Office of Hemp Enforcement website at www.vdacs.virginia.gov/food-hemp-product-enforcement.shtml. Facilities should make sure they remain in compliance with regulations and submit renewal applications before their registration expires. Applications can be sent by email to hempregistration@vdacs.virginia.gov with proof of online payment, or by mail with a check or money order.
